Kiji

Kiji End User License Agreement

Effective 27 September 2026.

This End User License Agreement ("Agreement") is a binding contract between you and Hamdi Jomaa, entrepreneur individuel (EI), a French sole trader, 41 B rue des Roches, 45210 Ferrières-en-Gâtinais, France, SIREN 927 699 579 ("we", "us"), the developer of Kiji ("the App"). It governs your use of the App and of the sync service the App connects to (together, "the Service").

This Agreement is concluded between you and us only. Apple Inc. and its subsidiaries ("Apple") are not a party to it. We, not Apple, are solely responsible for the App and its content.

By downloading, installing or using the App you accept this Agreement. If you do not accept it, do not use the App.

1. Licence

We grant you a personal, non-exclusive, non-transferable, revocable licence to use the App on any Apple-branded device that you own or control, in the manner permitted by the Usage Rules of the Apple Media Services Terms and Conditions in force at the time. The licence covers use of the App and, with an active plan, of the Service.

Where Family Sharing or volume purchasing applies, the App may be used by the other members of your family group as permitted by those Usage Rules.

You may not sell, rent, sublicense, redistribute or lend the App, nor copy it, modify it, reverse engineer it, decompile it or attempt to derive its source code, except to the extent that applicable law expressly permits you to do so notwithstanding this restriction — which, in the European Union, includes the interoperability rights under Directive 2009/24/EC.

2. Plans, purchases and renewal

Kiji requires an active plan, bought through the App Store.

Plans differ in how much media (images and video) an account may keep and in support: Pro and Lifetime include priority support, and everyone can write to support. If a plan lapses, your content is kept, but the App is locked for editing until a plan is active again. You can always export your data and delete your account from within the App, with or without an active plan.

3. Right of withdrawal (EU, EEA and United Kingdom)

If you are a consumer resident in the European Union, the European Economic Area or the United Kingdom, you normally have 14 days from purchase to withdraw from it without giving a reason.

Purchases are made from Apple as merchant of record, so whether and how that right applies is governed by Apple's policy, and a withdrawal or refund request is made to Apple through reportaproblem.apple.com. We will help if you contact us at the address in section 17.

4. Your account and your content

You sign in to the App with Apple, with Google, or with an email address and password. You are responsible for keeping those credentials secure.

What you write and add in Kiji stays yours. We claim no ownership of it. We store it, and grant ourselves no rights over it beyond the strictly technical ones needed to host, transmit, back up and sync it to your own devices at your direction. We do not sell it, share it or use it for anything else. Deleting your account deletes your content, as described in the Privacy Policy.

5. Acceptable use

Do not use Kiji to store, sync or share content that is unlawful, that you have no right to store, or that harms others; do not use it to attack, overload or circumvent the Service; and do not use it in breach of the sanctions and export rules in section 12.

6. Maintenance and support

We alone are responsible for maintaining and supporting the App. Apple has no obligation whatsoever to furnish any maintenance or support services for it. Reach us at hamdijomaa.x@gmail.com.

We supply the App and the Service with reasonable care and skill.

If you are a consumer in the European Union or the European Economic Area, we are liable under Directive (EU) 2019/770 for any lack of conformity of the digital content or digital service that exists at the time of supply and, for a continuously supplied service, throughout the period of supply — for at least two years from supply, or for the whole duration of your subscription, whichever is longer. You are entitled to have the App brought into conformity, or to a price reduction or termination of the contract, on the terms that Directive and your national law provide. You pay nothing for this and nothing in this Agreement limits it. Consumers in the United Kingdom have corresponding rights under the Consumer Rights Act 2015, and consumers elsewhere have whatever rights their own law gives them.

Subject always to the paragraph above, and to the maximum extent your law permits, the App is otherwise provided "as is", without further warranty.

In the event of any failure of the App to conform to any warranty that does apply, you may notify Apple, and Apple will refund the purchase price of the App to you. To the maximum extent permitted by applicable law, Apple has no other warranty obligation whatsoever with respect to the App. As between us and Apple, any other claim, loss, liability, damage, cost or expense attributable to a failure to conform to a warranty is our sole responsibility.

8. Claims about the App

We, not Apple, are responsible for addressing any claim by you or a third party relating to the App or your possession and use of it, including product liability claims, any claim that the App fails to conform to a legal or regulatory requirement, and claims arising under consumer protection, privacy or similar law — including claims under the Health Insurance Portability and Accountability Act (HIPAA) where it applies.

9. Intellectual property

The App, its design and its code remain ours or our licensors'. This Agreement grants you a licence, not a sale.

If a third party claims that the App or your possession and use of it infringes that third party's intellectual property rights, we, not Apple, will be solely responsible for the investigation, defence, settlement and discharge of that claim.

Apple and its subsidiaries are third-party beneficiaries of this Agreement, and upon your acceptance of it Apple will have the right — and will be deemed to have accepted the right — to enforce this Agreement against you as a third-party beneficiary of it.

10. Third-party services

The App relies on services we do not control: Apple, for sign-in, purchases, notifications and delivery; Google, for Google Sign-In if you use it; Supabase, for hosting your account and content in the European Union; and PostHog, for analytics (with your consent where it is required) and crash reports, as described in the Privacy Policy. Your use of the App is also subject to the applicable third-party terms of those services, and we are responsible to you for the App itself, not for those services' availability.

11. Privacy

We handle personal data as set out in the Privacy Policy, which forms part of this Agreement. If you are in the European Union or the European Economic Area, we process your data as controller under Regulation (EU) 2016/679 (GDPR), and you keep every right that Regulation gives you, including access, rectification, erasure, portability, restriction, objection, and complaint to your national supervisory authority.

12. Sanctions and export

You represent that you are not located in, and are not a national or resident of, a country subject to a US Government embargo or designated by the US Government as "terrorist supporting"; that you are not listed on any US Government list of prohibited or restricted parties; and that your use of the App complies with all applicable export and sanctions laws, including those of the United States and the European Union.

13. Liability

Nothing in this Agreement excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, for gross negligence or wilful misconduct, or for anything else that the law of your country of residence does not allow to be excluded or limited. Nothing in this Agreement limits the mandatory rights that the consumer law of your country of residence gives you.

Subject to that, and to the extent your law permits, we are not liable for indirect or consequential loss, for loss of profit or business, or for loss of data that a reasonable backup on your own devices would have prevented; and our total liability arising out of this Agreement is limited to the greater of the amount you paid us for the App and the Service in the twelve months before the event and EUR 50.

Keep your own copies of anything you cannot afford to lose.

14. Term, suspension and termination

This Agreement runs until terminated. You may end it at any time by ceasing to use the App, deleting it, and — if you wish — deleting your account in the App. We may suspend or terminate an account that materially breaches this Agreement, after giving you notice and a reasonable opportunity to put things right where the breach can be put right and the law requires it. Termination does not affect refund or statutory rights you have already earned.

15. Changes to this Agreement

We may change this Agreement, for example to reflect changes to the App or to the law. We will give reasonable notice of a change that materially affects you and, where the law requires it, ask you to accept it or let you terminate. The date at the top says when it last changed.

16. Governing law and disputes

This Agreement is governed by the law of France.

If you are a consumer, this choice of law does not deprive you of the protection of the mandatory provisions of the law of the country in which you are habitually resident (Article 6 of Regulation (EC) No 593/2008, "Rome I", for consumers in the EU). Consumers may bring proceedings in the courts of their own country of residence, and we will bring any claim against a consumer only there.

We would rather resolve a complaint directly: write to hamdijomaa.x@gmail.com. If we cannot settle it, EU consumers may also turn to an alternative dispute resolution body in their own country. (The European Commission's ODR platform closed on 20 July 2025 and is no longer available.) We are not obliged, and do not commit, to use a particular ADR body.
